FIX8 Design – Privacy Policy

FIX8 Design respects your right to privacy and we are committed to safeguarding the privacy of our Clients and website visitors. We conform to the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth). The APPs govern the way we collect, use, disclose, store, secure and dispose of your Personal Information. FIX8 Design (“us”, “we”, "it" or “our”) operates the www.fix8design.com.au website and may hereinafter be referred to as our “Service”. Our privacy policy defined hereinafter informs you of our policies regarding collection, use, and disclosure of your Personal Information/Data when you use our Service, and your choices in regards to that Personal Information/Data and how we use it. We may use your Personal Information/Data for the purpose of providing and improving upon our Service. By using our Service you agree to the collection and use of Personal Information/Data in accordance with the information outlined in this Policy. 1. Definitions

1.1 “Service” shall mean the service/s and supply of “Goods” (as defined in clause 1.3 of FIX8 Design - Terms and Conditions). Service may also be in the form of education, and advice or in other forms whereby the Client receives the Service.
1.2 “Data”, “Information” and “Personal Information” are terms often used interchangeably throughout this policy, and refers to information we hold for the purpose of improving our Service and is where explicitly noted—identifiable as being about you. It should be noted that not all Data holds Personal Information, and not all Personal Information is held as Data.
1.3 “Third Parties” in the context of this privacy policy shall mean other parties outside of the Client / Supplier relationship that relate to, or are involved in the operation of the Suppliers business affairs and dealings including but not limited to Service, advice and supply of Goods.

2. Information, Collection, and Use

2.1 We collect different types of Personal Information/Data for various purposes and in different forms. We collect Personal Information/Data for the primary purpose of improving our Services to you.
2.2 We may use the Personal Information/Data we collect in various ways, including, but not limited to:
(a) Providing, operating, and maintaining our website.
(b) Improving, personalising, and expanding our website.
(c) Understanding and analysing how you use our website.
(d) Developing new Products, Services, features, and functionality.
(e) Communicating with you, either directly or through one of our partners; including for customer service; to provide you with updates and other information relating to our website; or for information relating to our Services; and for marketing and promotional purposes.

2.3 We will sometimes collect and store your Personal Information/Data you enter onto our website, or your Personal Information/Data you provide to us directly, or through means of correspondence in other forms such as, but not limited to: via electronic means; emails, web forms, browser cookies, and in person; via surveys, interviews, forms filled out by hand, and written signatures that may be retained on job request forms, quotations, and other documentation and contracts.
2.4 We will collect basic Personal Information/Data such as, but not limited to: your name, surname, business name/s, phone number/s, physical address/s, web URLs, email address/s, ACN, and ABN number/s to enable us to provide you with better Service, and liaise with you in other ways relating to our business dealings and affairs with you.
2.5 We may collect Personal Information/Data from Third Parties. We do not guarantee the policies of Third Parties, however where reasonable and practicable to do so we will only collect Personal Information/Data from you, and will take reasonable steps to ensure that you are notified and made aware of any Personal Information/Data provided to us by a third party.
2.6 We may collect other Personal Information/Data including, but not limited to: when receiving your feedback on the Goods and Services that we have provided to you; or when you provide Information about your personal or business affairs; or when you change your contact details; or when you respond to our surveys, and/or promotions, email, or other correspondence; or when you provide financial Information; or when you communicate with any of our staff regarding any of the above.
2.7 Additionally we may collect all/or any other Personal Information/Data you provide to us where deemed necessary, and reasonably practicable to do so in order to better provide our Service to you.
2.8 We may contact you regarding the collection of Personal Information/Data by a variety of means including, but not limited to; via telephone, email, SMS, postal services, or any other means deemed reasonably practicable.

3. Log Files

3.1 We follow a standard procedure of using log files. These files log visitors when they visit websites. All hosting companies do this and it is a part of a hosting Services' analytics necessary for the improvement of Service. The Information collected by log files include such things as: internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date and time stamp, referring/exit pages, and possibly the number of clicks. These are not linked to any Personal Information/Data that is personally identifiable. The purpose of such Information is for analysing trends, administering the site, tracking users' movement on the website, and gathering demographic Information.

4. Tracking and Usage of Data

4.1 We may use cookies and other tracking technologies to collect Data. Cookies are sent to your browser and stored on your computer or device. Such technologies are not malicious and are only used to collect and track Information about you that will serve to improve; and help us analyse our Service. Most web browsers such as Chrome or Firefox collect cookies automatically. You can if you choose to, reject cookies by disabling them in your browser settings, however this may prevent you from taking full advantage of our website and its’ features.
4.2 We may use any number of cookies such as, but not limited to:
(a) Session cookies to improve the operation of our Service.
(b) Preference cookies to remember your preferences and settings for next time you visit our website.
(c) Security cookies to improve online security.
4.3 We may also collect usage and other diagnostic Data to help us analyse how our website is accessed and used. Such Information may include, but is not limited to: Information such as your computer or device’s Internet Protocol address (IP address); or our website pages that you have visited and the time you spent browsing them; and the time and date that you visited our website’s page/s; and your web browser type and version; or any other data used by us to help in analysing and improving our Service.

5. Disclosure of Your Personal Information

5.1 We may disclose your Personal Information/Data to any number of parties including but not limited to: employees, officers, insurers, professional advisers, agents, suppliers, subcontractors, or Third Parties insofar as deemed reasonably necessary or practicable for the purposes set out in this policy.
5.2 Your Personal Information/Data may be disclosed under a number of circumstances in good faith, and where deemed necessary; including but not limited to the following:
(a) to Third Parties where you consent to the use or disclosure; and
(b) where required or authorised by law; and
(c) to protect and defend the rights or property of FIX8 Design; and
(d) for the prevention of, or the investigation of any wrongdoings in connection with our Goods or Services; and
(e) to protect the personal safety of our Clients or the public; and
(f) to protect against legal liability.
5.3 We may need to disclose of your Personal Information (as outlined in clause 5.2b), to comply with a legal requirement, such as a law; and/or a court order; and/or a regulation; and/or a warrant; and/or a subpoena; and/or in response to a law enforcement agency request; or for any other legal proceeding or requirement.
5.4 Additionally we may also use your Personal Information to protect the copyright, trademarks, or other legal rights; and other property; physical, digital, or intellectual; or for the safety of FIX8 Design, its principle place/s of business, its website: www.fix8design.com.au, its staff, its Clients, or any Third Parties.
5.5 In the event that the ownership of the business of FIX8 Design is transferred, we reserve the right to transfer to the extent permissible by law; our databases, together with any Personal Information/Data contained in those databases under an agreement for the new owner to maintain confidentiality of that Information, and seek only to disclose of Personal Information/Data in good faith and when necessary as outlined in this privacy policy.
5.6 By providing us with Personal Information/Data, you consent to the terms set out in this privacy policy, and the types of Information that we may disclose as outlined in this herein.

6. Security of Your Personal Information

6.1 We take every measure and precaution necessary to ensure the security of your Personal Information/Data against unauthorised access or disclosure, misuse, interference, or modification, however no method of transmission of Data over the internet, or method to store Data is 100% secure. We cannot therefore guarantee absolute security of your Personal Information/Data, and by agreeing to this privacy policy you accept that we will not be held accountable in the event that there is any security breach involving or exploiting your Personal Information or Data.

7. Third Parties Privacy Policies

7.1 We may consult other Third Parties; to collaborate with, or outsource work to external Service providers to provide the Service on our behalf, or to facilitate in delivering our Service better. In certain circumstances these Third Parties may have access to your Personal Information/Data where necessary; and where it is reasonably practicable to obtain your Personal Information/Data to perform tasks on our behalf, and are obligated not to use it, or disclose it for any other purpose.
7.2 FIX8 Design's privacy policy does not apply to other Third Parties; advertisers or websites, and as such we are not responsible for the privacy practices of other websites, thus we advise you to consult the respective privacy policies of these Third Parties for more detailed Information on their privacy practices. It may include their terms and conditions and practices and instructions about how to opt-out of certain options. 8. Transfer of Data

8.1 FIX8 Design may transfer your Personal Data to a server; or hosting company; or other Third Party located in another country outside of Australia; Australian state, province, country or other governmental jurisdiction where data protection laws may differ from that of Australia’s state, province, country or other governmental jurisdiction. Your consent to this privacy policy followed by your providing of Personal Information/Data represents your agreement to that transfer. In such a circumstances FIX8 Design will make every effort to inform you if your Personal Data is to be held on servers outside of Australia. As of the time of this writing any websites we host are held on Servers within Australia.

9. Access to Your Personal Information

9.1 If you would like details of the Information we hold about you, then you are entitled to that Information in accordance with the provisions of the Privacy Act 1988 (Cth). Please be aware that upon requesting Information, a small administrative fee may be charged for the retrieval and delivery of such Information.
9.2 Under certain circumstances, we reserve the right to refuse to provide you with certain Information that we hold about you as indicated in the Privacy Act 1988 (Cth).
9.3 If you would like a copy of the Information we hold about you, or you believe that there are any inaccuracies in that Information such that it is misleading, irrelevant, incomplete, or out of date, you can notify us by emailing FIX8 Design at: service@www.fix8design.com.au

10. Children’s Policy

10.1 FIX8 Design does not knowingly collect Personal Information on anybody under the age of 18 years.
10.2 If we become aware that we have been provided Personal Information from children under 18 years of age, without the consent of a legal parent or guardian, then we will take necessary steps to remove such Personal Information from our servers and databases. If you are a legal parent or guardian and you believe we have unknowingly collected Information from your child/children, then we ask you to please contact us and we will remove the Personal Data from our servers/databases accordingly.
10.3 By accepting this privacy policy you agree that FIX8 Design will not be held accountable if we have unknowingly collected Personal Information/Data from children under the age of 18 and are not to be held accountable for any breaches of the security of such Personal Information/Data, or the use of such Personal Information/Data should such a breach occur.

11. Changes to This Privacy Policy

11.1 FIX8 Design may update or change this privacy policy from time to time. We will do our best to notify our clients and viewers of our website of any such changes, however you are advised to review this privacy policy periodically for any changes.

While we follow best practices, and take every precaution to safeguard your Information we cannot be held accountable due to unforeseen circumstances arising beyond our control such as security breaches and hacking. Please also refer to our Terms and Conditions for more information.

By using our website and/or engaging our Service/s, you hereby consent to our privacy policy and agree to its terms. You agree that errors and/or omissions that may arise in this policy are excepted.
